By downloading, installing, or using the Kaleido Travel mobile application and related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, please do not use the Services.
These Terms constitute a legally binding agreement between you and James van den Hoorn ("Kaleido", "we", "us", or "our"), the developer and operator of Kaleido Travel.
You may create an account using an email address and password, or via Google Sign-In. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
Notify us immediately at jamievan44@hotmail.com if you suspect unauthorised access to your account. We are not liable for any loss resulting from your failure to keep your credentials secure.
You may not create multiple accounts or share accounts with others.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the Kaleido Travel app on your personal iOS device solely for your personal, non-commercial purposes.
You may not:
"Content" means anything you submit to the Services, including tips, reviews, ratings, photos, voice recordings, journey names, stop names, and profile information.
By submitting Content, you grant Kaleido Travel a worldwide, royalty-free, non-exclusive licence to store, display, distribute, and reproduce your Content as part of operating the Services. This includes displaying your public content to other users and caching it to improve performance. You retain ownership of your Content.
By submitting Content, you represent that:
We reserve the right (but have no obligation) to remove Content that violates these Terms or our Community Guidelines, at our sole discretion and without prior notice.
You agree not to use the Services to:
Violations may result in content removal, account suspension, or permanent termination.
The App integrates with third-party services including Google (Maps, Places, Firebase), Viator, and others. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the accuracy of third-party data (e.g., venue information, tour listings) or the actions of third-party providers.
Tour and activity listings displayed from Viator are for informational purposes. Bookings made through Viator are governed by Viator's own terms and are between you and Viator/the activity operator.
Kaleido Travel awards points, badges, and similar virtual items as part of its gamification system. These have no monetary value, cannot be transferred, sold, or redeemed for cash, and may be adjusted, reduced, or removed at any time at our discretion. We may modify the points and rewards system without notice.
All intellectual property in the App — including the name "Kaleido Travel", logo, design, code, and proprietary data — belongs to James van den Hoorn. Nothing in these Terms transfers any IP rights to you beyond the limited licence in Section 4.
Community-aggregated venue data (aggregate ratings, visit counts) is a collective dataset owned by Kaleido Travel. Individual contributions remain yours under the licence in Section 5.2.
The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses. Venue information, opening hours, and ratings provided through the App may not be accurate or up-to-date — always verify critical information (especially safety-related) through official sources before relying on it.
To the fullest extent permitted by applicable law, Kaleido Travel and James van den Hoorn will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Services.
Our total cumulative liability to you for any claims arising under these Terms will not exceed the greater of (a) the amount you have paid us in the 12 months preceding the claim, or (b) £100 GBP.
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited by applicable law.
You agree to indemnify and hold harmless Kaleido Travel and James van den Hoorn from any claims, damages, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Services; (b) your Content; (c) your violation of these Terms; or (d) your violation of any third party's rights.
You may delete your account at any time via Settings → Delete Account in the App, or by emailing us. Upon deletion, your personal data will be removed as described in our Privacy Policy.
We may suspend or terminate your account immediately, without notice or liability, if you breach these Terms or if we are required to do so by law. We may also terminate or restrict the Services at any time for any reason with reasonable notice where practicable.
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws in your country of residence grant you additional rights.
If you have a dispute with us, please contact us first at jamievan44@hotmail.com and we will do our best to resolve it amicably.
We may update these Terms from time to time. When we do, we will update the "Last updated" date above. If changes are material, we will notify you via push notification or in-app alert at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the updated Terms.
